The site is available for users if you are at least 18 years old. In order to use the site as a buyer, seller or artist you must first register. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. We aim to provide an effective platform for you to list artwork (or other goods) for sale (“Seller”) or buy such goods (“Buyer”) - we make our services available through our website, mobile applications, and other platforms. However, we are not acting as agent of the Seller. Our aim is to provide a favourable experience for both our Sellers and Buyers.

If you are a Seller offering artworks you shall:

• post a description of the goods offered and set a price. Sellers are solely responsible for the description, condition, authenticity, and quality of the goods offered;

• represent and warrant that you are free to sell the goods offered and that the sale to any Buyer will be free of any charges or encumbrances.

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must not provide content that is illegal, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourage conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the site a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you license to us are described in the next paragraph (Rights you license).

You cannot provide content that you do not have the right to submit, unless you have the owner's permission; this includes material covered by someone else's copyright or any other proprietary right.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards posted on the site.

The views expressed by other users on our site do not represent our views or values.

When you upload or post content or submit material to our site, you grant to us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, distribute and display images of your artworks in connection with the service provided by the site and across different media and for the purposes of marketing and promotion of the site and ArtRehome Ltd. You represent and warrant that you own or otherwise control all of the rights to the content that you upload or post.

Using the Website is free for Buyers.

For Sellers (or Artists who are acting as Sellers), you will pay to us a commission based on sale proceeds for selling an artwork. This fee is anything from 7.5% to 15%, based on our Fair Pricing Policy and our suggestion is starting at 10% of sale proceeds (less transport costs).

As explained below (PURCHASING ARTWORKS) our site effects an introduction between Buyer and Seller and Buyers can make an offer for the purchase of artwork on the site. If a Buyer and Seller of an artwork listed for sale on our site make contact independently of our site, and a sale of that artwork is agreed, then ArtRehome Ltd shall be entitled to claim the maximum sales commission of 15% of the original listed sales price of the artwork on our site and both the Buyer and the Seller shall be liable to pay us this commission within 14 days of our request.

Following such independent sale, we reserve the right to suspend or terminate the accounts of either the Buyer and/or Seller of the artwork.

If you are a Buyer you acknowledge that:

• Images of artworks on the site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the artworks. The artworks may vary slightly from those images.

• It is your responsibility to determine the value, condition and authenticity of the artwork.

• Your contract to purchase an artwork is with the Seller of that artwork and not with ArtRehome Ltd. You and the Seller will be responsible for the obligations of the contract and we exclude all liability arising from the purchase contract.

• It is your responsibility to ensure that you check that the Artwork is in the expected condition at the point of collection / receipt and not to take it / sign for it if you consider it to be damaged or misrepresented.

Buyers making an offer for the purchase of artwork on the site represent and warrant by placing any offer that they are ready, willing and able to pay the full purchase price, together with all agreed transport costs, within 24 hours of sale or purchase of any single item.

Upon acceptance of the Buyer’s offer to purchase artwork, we shall separately confirm the agreement to the Seller and notify the buyer submitting that the offer was successful.

We shall email both the successful Buyer and Seller and shall provide each with the name, address, telephone number and email address of the other; Buyer and Seller are thereafter solely responsible for arranging for the transmission of payment of the purchase price within 24 hours of the transmission of our email and for prompt shipment of the goods after receipt of cleared funds.

Any dispute with respect to the sale of any artwork shall be resolved between the Buyer and Seller and without the participation of ArtRehome Ltd. The Seller is solely responsible for collecting payment from the buyer. ArtRehome Ltd does not guarantee and is not responsible in any way for the performance of Buyers or Sellers participating in the sale of artwork on the site.

Accepted Payment Policy
